also.. is there a chance the evidence at the scene casts doubt on the story?

I thought this at first as well. Then I started thinking and read the police report and everything documented from the scene reinforces the story from the defendent and his wife. But that is what trials are for. I'll be keeping close taps on the procedings. They are currently in the first day of trial today. I have no idea as to how long it could take.

For me it really depends on the situation. If the person is in my house and has established his or herself as a threat, I don't care if the back is turned to me. They could just as easily run away and fire a gun blindly behind their back. Self defense encounters are unpredictable and there's no telling whether or not a perp will still be at threat with his or her back to me.

Sorry to make an example of you but I hate how people generally think if a back is turned that the threat is over. That is not the case.

But, all of this is contingent on the perp being armed. If there is no gun, knife, club, bat, baton, etc. and he or she is running away, I think letting them flee is the best option.

As for the OP, good to hear he got off!
