I'm way late to this.
Nas has a more natural flow. Em has gotten a bit smoother with his flow over time. I feel Nas has a better catalog, but Em's "wow" moments are better.
It's a tough one question to answer. As far as Legend? It has to be Em', for the simple fact that he defied the odds and was considered as several times in his career as the best current rapper, even though no one took white rappers seriously.
Another thing about Em: other rappers don't talk a lot about how good he is, and no real legit rappers go after him."Flows to wet. No one close to it. No one says it but still everyone knows the shite." "I joke when I say I'm the best in the booth but a lot of truth is said in jest." There's just this unspoken thing that you don't go after the white boy, because he'll eat you up. Even Nas had his nemesis (Jay-Z) that was up to his level. Who ever came after Em that could really go toe to toe with him? Royce Da 5'9, but they're cool now, and I'm not sure if he ever went directly at him.

I'm not denying that Illmatic is a fantastic album. I frickin' love Nas. It happens with every genre, though. Only so many bands/artists can make it through and get the mainstream acclaim that they deserve down the road. What, were the Beatles and Stones the only great bands of their era? Of course not. But go talk to the average 14 year old and see what band names they recognize from that era. For that matter, see if they even know who Nas is. I think that's pretty indicative of the point I'm making.

I love Nas but I think Eminem is a better rapper at this point. Obviously early 90's no one is fricking with Nas, but he hasn't hit that level many times since. Then again Eminem has become a fricking pop rapper and recovery was garbage.
Ultimately they are both in my top 5 current rappers right now.

There's always going to be a backlash against Eminem because he got so damn popular and was a major crossover success. Just shows hip hop fans are just as provincial as indie rock fans.
I love both, but I do think Nas had a greater peak. Illmatic is a classic album and one of the greatest debut albums by any artist in any genre. But the knock on Nas is that he never quite lived up to that brilliant debut. He's had some moments (I personally love Hip Hop is Dead), but his career has been one of a long, slow decline. And it seems silly to knock Em for crossover success when Nas made a blatant attempt at popular success on It Was Written (which is a good album, but let's not pretend he wasn't trying to get on MTV).
I think Em gave some credibility to the horrorcore genre and he's got a foot in the tradition of somewhat goofy shock lyrics dating back to rock bands like the Cramps or the Misfits (though obviously completely stylistically different). But Em really shines in the way he crafted a persona (Slim Shady) and kept deconstructing it in public view. He's kind of a master at that. The pairing of the Slim Shady and Marshall Mathers LP's is kind of great.
At the end of the day, I fell Eminem is a bit more unique. His phrasing just isn't going to be copied by anybody. Nas was just a really great rapper who once ruled NYC. Yeah, so did Kurtis Blow. Or KRS-One. Why is he different? (NOTE: All three are awesome and legends in their own right).
I'm not comfortable tearing either of them down, I just think Em's a bit greater. But both have a pretty secure legacy.

Come on Trill its not about units. If that were the case then Pop Music acts like Britney and Backstreet Boys are both better than Eminem and Nas.

i was just responding to the comment that Em's career is in a long slow decline, which isn't true, he's still selling a lot of records, not to many people can move that many units in one week.

I think both are clearly in decline. That's cool, it's hard to be on top of your game for 20 years, and there's a very short list of artists who have. I don't think that's a knock on either, but I don't think anyone can seriously argue Nas is putting out stuff the same quality as Illmatic or Eminem and the Marshall Mathers LP.
