LSU's Legal Machine - Honey Badger Items

Sooo, the LSU legal machine attacks a local entrepreneur in Tiger District with a cease and desist on Honey Badgert t-shirts, but decides to leave Walk-Ons alone for their "Honey Badger" drink? Hmmm, wonder why that is? Could it be about money?

There's nothing wrong with using the name "Honey Badger," as LSU doesn't own that. You can't use the name honey badger and associate it with a picture resembling Tyrann Mathieu or LSU.

Zippys and Sazaracs have HB drinks as well. They gave business the guidelines for what they could sell, and some aren't following the rules.

it isnt about money, its about ncaa rules and keeping tm7 eligible. if they dont atleast send out the letters tm7 would be ruled ineligible by the ncaa

SO a cartoon character sketch looks or resembles TM7 and/or LSU more than an actual nickname EVERYONE calls him? Even national broadcasters? I don't follow....

Honey Badger existed long before Mathieu was given the nickname. LSU doesn't own "The Honey Badger."

I'm failing to see how a drink nickname is any different than a shirt. Same principles apply. Obviously both people who sell their item want you to associate it with TM7 right? Even if they use his name, image or whatever the case is. Am I missing something? I mean I did get a dgree from LSU like everyone else, so I'm suppossed to be smart enough to understand right?

Since you havent been able to grasp this concept, you should probably just give up and trust us you are wrong. Don't feel bad...I don't fully understand particle physics.

A drink does not have enough by itself to identify TM7. But, honey badger wearing purple and gold with the #7 striking a heisman pose, well there is a difference.

The drink nickname isn't printed on a purple and gold shirt, holding a football making a Heisman pose.

Either way, I don't see what the big deal is. The shirt was pretty horrible looking and the drink doesn't sound very good.

Plus the honey badger is just the name for an animal, I doubt he would have any claim.

It's really simple. They can use a picture of a honey badger as long as they don't also have ANY association of LSU or TM7 on there too.

And he even did an official voiceover of TM highlights. And besides, I doubt he is going to sue LSU since they can't be held responsible for a nickname that started on the internet and haven't tried to make any money off of directly.

well most of the honey badger paraphernalia says things like "honey badger don't care" and "honey badger takes what he wants" which could be claimed as his IP

but as an internet character I'm sure he's not a big fan of IP law in the first place

Same here....then why does LSU feel the need to issue a cease and desist to Tiger District and not mess with anyone else? Such as a place where they coincidentally have radio shows etc.? Connection here maybe?

Legally speaking, it is probably MUCH easier to tie the connection to LSU and TM7 if you are creating a product that is using LSU colors, with the animal that bears the nickname of a current LSU player, wearing the same jersey number, on a football field, making a Heisman pose. See how easy that is to tie out a direct and explicit link to LSU and TM7.

Now, please show me all of the ties of the Honey Badger shot to TM7. I'll hang up and listen.
