I don't see how he could win this case, assuming it's "wrongful termination". He had already been reprimanded once for sexist comments, so it's not like ESPN's reaction to this one was unexpected.

How is this sexist?

Franklin also came under fire in 2005 for referring to sideline reporter Holly Rowe as "sweetheart" during a football game between Purdue and Notre Dame.

I think the only way he may have a case is if he can bring up ESPN's inconsistent policy when it comes to harassment by its employees.

If you're a favorite like Mike Tirico, you can get off with a suspension of 3 months.

If they don't like you, like Harold Reynolds, they can attempt to fire you for cause.

If you frick up on a spectacular scale, like Steve Phillips, you get suspended indefinitely and then fired once it becomes a big media story.

this is exactly what i was going to say, but more certain

ESPN has had a colorful past in terms of sexual harassment, and per deadspin, not everyone is treated the same

if franklin's lawyer is crafty, they'll write the pleading in this way to open up the possibility of deposing all the former ESPN employees who have come under the contract. that would be epic

He was specifically warned about his behavior and didn't stop. Now that his bad choices backfired, he thinks he's entitled to a handout.

If he's so great why doesn't anyone else want to hire him?
