Lawsuit challenging Louisiana’s hunting license checks without warrants poised for trial

For the past two years, an East Feliciana man has been challenging the constitutionality of the Louisiana Department of Wildlife and Fisheries hunting license stops on private property like the 240-acre commercial tree farm he owns in Ethel.

Thomas Manuel says gaming officials have unrestrained powers to barge onto his property for inspections under Louisiana’s “entry statute,” a law that currently allows the department to conduct searches without a warrant or probable cause. In his March 2024 lawsuit, Manuel contends the routine tag and license checks on his tree farm are an invasion of privacy, and they violate right to privacy protections in the Louisiana Constitution.

“It’s been well-established for 150 years that you need warrants to go on private land. The same as if a police officer wants to come into your backyard; they’d need a warrant first,” Manuel’s attorney, James Knight, said after a hearing last week. “Warrants are required whenever you want to go onto private property to search them. And right now, the department doesn’t do that. It just goes onto private land and roams around to see if people have committed crimes without even suspecting a specific crime.”

But state statutes give gaming officials authority to stop people on public and private lands to “see” if they’re violating wildlife law in those territories. That means game wardens can stop every hunter and check to see if they have their deer tags and hunting licenses. They can also inspect a hunter’s game to make sure they haven’t made any kills that are out of hunting season.

Ask the state to help pay for damages to your vehicle when you hit a deer on the interstate and see where that gets ya.

Is this the guy that was basically harassed by the game wardens who were coming in setting cameras and checking him way too often?

That can be your opinion but it's an incredibly important detail that has created the North American wildlife model which is the gold standard

Yes. And if you know Tom, you know he's a law-abiding citizen. Nice guy that you probably couldn't force to break a game law.

In La the re-establishment of deer in the 1940’s is an example. The difference is there are deer everywhere now (Tensas parish specifically) yet the gov keeps its foot down. Turns out it’s not about the deer, etc. after all.

Ok, if the state owns the wildlife on my land then they can pony up some for that property tax I pay every damn year.

It's not "owned by the state"

Wildlife is "held in trust for the public"



ETA: I am not saying its all perfect and works for great for everyone but the system as a whole works

If it's not owned then who gets the restitution funds for a game violation? Is it not the state?

I just find it ironic that I buy the land, pay taxes on the land annually, put money into the land for the benefit of the wildlife all so an outside bureaucratic agency can just step foot on it because they feel like it.

They will pay you to put land into CRP to benefit the game.


I am only pointing out counter arguments. We spend our money to benefit the wildlife to benefit ourselves. Deer will be just fine without supplemental minerals and food plots, and especially dried kernel corn spun from a feeder. We like to hunt and kill big deer though. So we do these things

A few years ago I was talking with a game warden. He told me about his attempts at catching a neighbor baiting turkeys. He described every food plot I have and said he was setting up on me waiting to hear my neighbor shoot.

I usually don’t go in till mid morning turkey hunting and that year I couldn’t find a bird. Turns out this douche was running everything off. To make it worse, my neighbors don’t turkey hunt. They run feeders in the spring and shoot hogs with thermals.

Game Wardens investigating criminal activity on private lands should be forced to get a search warrant before entering the property. If access through neighboring property is required, it should be granted only through land owner permission or as part of the search warrant
