Definition of tampering

Tampering is claimed to have occurred when a team tries to poach players on your team in the same way that your team has been trying to poach players from other teams.

Correct me if I am wrong, but a team can talk to an agent or third party all they want, can they not?

That’s tampering within the bounds of most professional sports leagues that have CBAs in place that specifically detail their definition of tampering and the punishments for it.
In color he since there is no CBA, I believe the tampering claims they can try would be tortuous interference with a contract. Based on what is being reported about the likely contract language it’s not a strong argument.

Tampering means the school or coach reached out to a player not in the portal.
Tampering does not mean that the player’s representative reached out to the school or coach and vice versa.

Tampering sounds harsh, but everyone does it and there’s no one to enforce penalties if caught tampering. It would be like the bank robber tattling on the child molester.

All of it is done between agents now. It's an ethically grey area. It satisfies the letter of the rules but circumvents the spirit of the rules.
Do we need better rules to clean all of this up? Definitely, but in its current form, you can't fault schools for playing the game by the rules that they are given. The real villain in all of this is the NCAA for sitting back and taking a cut of revenues without providing adequate structure and rules.
