Man in NC gets car wrecked by Hispanics & arrested because he held them till police came.

A Zebulon man is being charged with "hate crimes" for detaining two Hispanic passengers reportedly attempting to flee after t-boning his truck
Surveillance video shows the (also Hispanic) driver of the vehicle running off after tearing through the grass to crash into the vehicle driven by Austin Thomas Herber, leaving one of his passengers unconscious and covered in blood
Herber is accused by the police of threatening the passengers of the offending vehicle with a gun and kicking them in the heads
However, eyewitnesses such as an owner of the restaurant Herber was pulling out of said she didn't observe a gun or "ethnic intimidation," only Herber putting his hand on the shoulder of the Hispanics and telling them to get on the ground and not leave, as they were trying to do
ETA: Police charged the reckless, probably drunk, driver with misdemeanors.

In NC, limitations on the use of deadly force include not being the initial aggressor and not using deadly force to protect property. See North Carolina General Statutes §14-51.3 and §14-51.2
FTR, I agree that the “hate crime” enhancement is complete BS.

And someone ELSE clearly said he did so, or there would be no charges. Resolving that conflict is why we have juries.
