Where are people getting this mythical "27 mill" (not 54 mill) agreement from?

No one knows anything because it hasn't been settled yet. But there is certainly an opportunity for LSU to negotiate a lower buyout based on timing and "finding new job" clauses.

I had heard settlement was 40% of contract but in upfront payment rather than over time of contract.

$54 million is the total if paid in installments over the next 6 years. The lower amounts listed or possible one lump payment projections or possible offers. This would need to be approved or negotiated by both sides.

Nobody here knows the terms of the contract.

Did they stick to the initial agreement? If so, was there wording in there about Kelly attempting to find a new job? If so, Kelly has a duty to mitigate. If he gives a half-assed effort to mitigate, LSU could sue. I don't know to what extent he has to do so, but I'd imagine if the BC job opened up for example, that's a reasonable replacement and he'd be forced to take it or else he would breach the contract. No it's not a major job to most people, but it's an FBS head coaching position at a power 5 school.

If they went with a whole new contract (accord and satisfaction), all that is out the window.

The truth is none of us here know.

First, $54 million over time is not $54 million. You can buy an annuity for less, so a lump sum of less is worth the same to the recipient. Secondly, there is a mitigation clause in the contract, that if LSU waived, would relieve Kelly of having to interview for new jobs for the next few years or take a new job without losing his payout or having to pay LSU back. Third, they may have dirt on him or he may realize that playing hardball with LSU will make it hard to find another gig, if he still wants one.

I would stay pat with my payoff only if I planned on retiring, which he may. However, I think his ego is to big to go out like a loser, so he will negotiate a lower payout.

My sister in law has a friend that sits in Gordon Mckernans suite and they said LSU wasn't going to have to pay the full $53 million due to a morality clause in the contract where he was having an affair. So they told him either accept the reduced amount or he could take them to court and everything would then go public including all of the affair info. Makes sense and very prudent of LSU to use that. Kelly didn't want to put his f amily through that public humiliation.
