The judge said the evidence presented to the grand jury was insufficient to support the terrorism charge.

“While the defendant was clearly expressing an animus toward UHC, and the health care industry generally, it does not follow that his goal was to ‘intimidate and coerce a civilian population,’ and indeed, there was no evidence presented of such a goal,” the judge wrote in a decision issued on Tuesday morning.

Prosecutors argued Mangione’s actions intimidated or coerced employees of UnitedHealthcare, but Carro rejected the argument those fears are enough to justify a terrorism charge.

Carro also tossed a second-degree murder charge, related to killing as an act of terrorism.

The rest of the indictment remains, with the judge refusing to dismiss another second-degree murder charge, to which the accused killer has pleaded not guilty.

Terrorism does seem borderline here, to me. He'll still go away forever, deservedly so.

I bet a deep dive into this judge's background would show sympathy to the defendant's motivations and actions.

It certainly seems to me terrorism laws should be broad enough to include violence to coerce/threaten a specific class in relation to a political/other cause (ie, those running healthcare companies).

ETA:

Having looked at it, it makes more sense. Post-9/11 terror laws in NY allow for a first degree murder charge, otherwise Mangione wouldn't qualify to my knowledge. So I'm guessing that's why the terrorism statute was used.

I may side with the Judge on the legal argument but, if I were the Prosecutor, I would have cited all of the "supporters" of Mangione who are cheering the killing and calling for more. Those people want to effect national change based on violence and it could be argued he is part of that movement. If his actions are based on that movement then that is terrorism.

those charges would likely be difficult to prove in court
better off removing them to avoid any sort of technicality the defense could latch onto to impact other charges

He’s facing a variety of federal charges, as well as state charges in New York and Pennsylvania.

It’s not a surprise that some of the state charges get dropped as he proceeds towards trial in three different courts.

It must not have coerced them much. My UHC premium just increased $70 a week.

Just because someone follows the letter of the law doesnt make them a sympathizer, you clown.

There is a long line of people that I will mourn for before I shed a tear for the UNH CEO.
UNH has the highest Claim Denial Rate of all insurance companies.
Do you have any idea how many people died because UNH denied coverage so they could line their pockets ?
Or the hell they put families thru while Doctors & family members sat on the phone for hours trying to get approval for treatment ?
And that their CEO championed these policies so he could drive the stock price and line his pockets ?

I feel horrible for Charlie Kirk & that girl in Charlotte.
The greedy UNH CEO, not so much.

There are a list of aggravating circumstances for murder one in NY and Mangione doesn't clearly meet any of them. The terrorism angle gave them a murder one basis.

But M1 in NY isn't particularly necessary with the death penalty now out in NY, and M2 can (as I understand it) pretty much otherwise stand as equivalent to M1 elsewhere.

TLDR: He can get life in prison for M2 in NY.

Clueless people think Luigi Mangione just picked the UNH CEO out of a phonebook.

Anthem had a controversial policy that they were preparing to implement regarding caps on coverage for anesthesia.
Anthem immediately discontinued that policy after UNH CEO was shot.
And UNH stock crashed after UNH management decided maybe they should consider denying fewer claims

He was appointed by the last Republican governor of New York (Pataki).
