Even from Justice Kavanaugh's questioning, I think this will be a loss for the good guys.

Win or lose, Solicitor General Bauer is doing an EXCELLENT job for the Trump Administration.

If you thought they were going to end birthright citizenship then you will be disappointed, it’s never going to happen

Same with Barret.
Again, until Congress acts to clip the Judicial Branch's wings on this, the pleadings here, right as they are, are likely to fail. There simply is little to no chance the JB, or either other branch, will voluntarily disempower itself, Constitutional intent be damned.

Maybe the poli talk lawyers could opine. But don't always judge questions, or by Jackson or Kagan how it will go...
It is all on Roberts, this can't be denied.

Yep, agree. The strategy, if I’m understanding correctly, was that the administration acknowledges the law but the argument is they are within the law by providing the ability for subject individuals to sue? Do I understand the gist?
Barrett giving the SG a hard time basically answered how this will go. I will say it’s a bold argument to make and he did a good job considering it’s a bit of a stretch argument
