The Founders never intended for the courts to be the final say on what is and is not constitutional. There is a reason they didn't give the courts any means of enforcement.

Can you elaborate?

I'm inclined to flatly disagree with that statement, but I'm remaining open minded to give you a chance to substantiate it.

If your argument is simply that they have no enforcement mechanism then I'll go ahead and disagree, since the Executive branch is the only branch with any enforcement mechanism yet we know they didn't want a dictatorship or oligarchy with only the POTUS and governors having unchecked authority.

While I agree that each branch has an equal duty to independently uphold the Constitution (Jackson wrote extensively about this with respect to the Bank of the U.S.), Federalist No. 78 clearly outlines judicial review and the Court’s role. This role is very powerful, which is why the Court was given “neither force nor will.” This outline of judicial review has been the law since nearly the beginning after Marbury v. Madison
