I figured he knew this was going to be litigated and the purpose was to get the USSC to rule on it.

A fair point. If that's invoked, illegal aliens may suddenly decide they can commit crimes, on top of the very first laws they broke upon entering the country, with the protections given to enemy invading soldiers or diplomats. Far too many seem to already run rampant anyway, somehow thinking the law doesn't apply or whatever. Nobody, not the ACLU, not truly legal immigrants, not probably most Americans, want them to actually have a case for that point that actually has legal merit and could win.

It's a straightforward consitutional question of interpretation. If I'm the ACLU, I'd keep it that way.

This.

You'd think with the current makeup of the USSC that they would have been smart enough to not litigate it and wait for the next Democrat that gets in to overturn it with their own Executive Order.

I don't know why they would want this EO to set case law, unless they have reason to think that Roberts and ACB will side with the liberals again.

So what exactly are the terms of the EO, whens the cutoff date?

Frick the ACLU. I just learned in a different threads article that Biden brought in 200k Afghan refugees. That's crazy, and we need to stop immigration abuse across the board, and can't have freebies like this anymore.

You hit the nail on the head.

The libtards play the "Founding Fathers could not have forseen modern technology," card when it suits them in cases of 1A and 2A issues. But play the card back on them over immigration and anchor babies (14A) and they have a cow.

The 14th Amendment is not a Founding Father's Amendment ... it's a Reconstruction Amendment not ratified until 1868 and it was done for one express reason.

And the ACLU is literally a communist organization.

You have this backwards.

MAGA types melting over children of illegal immigrants being citizens = "the Founders couldn't predict modern technology"

Just as MAGA types allegedly dislike the Constitution being a living document and want originalism and textualism, but in this case want to make the Constitution a living document and ignore those analyses.
