I understand it’s card only at Saints games and such
Most major event venues across the country have gone to this.

Which I assume would include a fee on top of already ridiculous prices for concessions etc.
Your assumption is incorrect.

I bet the fee is baked into that $12 beer. Won’t argue cards are easier. But one should have a choice. I don’t want a cashless society, although I rarely carry it.

You pay that fee. Whether you realize it or not, or whether it is outright stated or not, you pay it. Any business that does card transactions is not footing the bill for a per-transaction charge. I've actually been in three different restaurants in the past few months that have signage that openly states there are two prices, a cash price and a card price, with the cash price being cheaper.
You do pay a fee.

And it is illegal for them to do so.

31 U.S. Code § 5103 - Legal tender
United States coins and currency (including Federal reserve notes and circulating notes of Federal reserve banks and national banks) are legal tender for all debts, public charges, taxes, and dues. Foreign gold or silver coins are not legal tender for debts.
I don't understand why the treasury doesn't just enforce existing laws. Seems redundant that this needs to be codified.
