It depends on how you structure things, but the school takes on all of the risks, as do the NIL sponsors it affiliates with.

The kid can just do whatever the frick he wants whenever he wants.

If NIL persists, there needs to be some type of contractual protection for the school like we have in all other professional sports.

You said the university has no control over NIL. Which is technically correct. But they do have behind the scenes control.

Yes, they even influence the wording of the contracts. Maybe not through independent deals, but certainly through the collective.
