... I am not a lawyer, but how could anything be a contractual violation, if it was not specified in the contract?

It’s an interesting question. Was there a specific denial of this use case, or was this use case never mentioned in the agreement?

Imagine an artist who sells the Polaroids of his models long after the paintings are sold.
