Medical MMJ and work drug screens

Our company does not officially have a policy on this. Has anyone heard of someone losing their job over a positive test and had a script for it?

I would assume most big companies should have a specific policy.

It's cheaper to get from the clinics directly. LOL. or from leroy on the corner but it may have fentanyl in it.

Yes. Depends on what state you are in but most states that permit medical marijuana still don’t provide job protections for its use. Your mileage may vary.

It's covered under the substance abuse policy. Some companies have adopted medical programs, but not many that I've seen. Until it can be tested like alcohol, it won't be accepted in workplaces (IMO).

If you have a script from a doctor then you’ll be in the clear, just don’t give any other reasons to fire you.

If your company does random screens, then I highly doubt that they care if you have a prescription or not. Better start detoxing now.

My company is very specific. Any positive test for any THC product, legal or illegal, is a violation of its zero tolerance policy. It’s ridiculous.

And yes, people have gotten fired for pissing hot. Mostly people that have gotten in wrecks in company vehicles.

Marijuana is labeled a schedule 1 controlled substance by the federal government. Until it’s removed from that list, prescription or not, your job can still drug test you and fire you for smoking weed. Employers (especially in a safety sensitive field) and insurance companies have to abide by federal law.

A millwright in Oregon had a script and pissed hot and was fired.

The case went to the state Supreme Court and they ruled in favor of the company.

So, yeah.

Until it is legalized federally none of these medical or recreational changes at the state level mean a damn thing for people with jobs that still drug test.

Do you know who’s exempt from drug testing for weed in Louisiana, if they have a medical marijuana card? Government and state workers. Now tell me how that’s right.

The company I worked for required all employees to sign an agreement not to use any cannabis products, not even legal hemp products. You didn't have to sign the agreement, but if you didn't, they fired you. Your choice.

We've got employees that actively farm Marijuana. But use is still against company policy, "medicinally" or not. So if you piss hot it's on you. The only out legally is through ADA.
