Three People arrested for "Hate Crimes" for passing out White Supremacist pamphlets.

Look, I'm not down with discrimination, but arresting people for passing out pamphlets is just out of control.

Did you read the article? They weren’t standing on a public side walk passing it out, there were targeting Jewish and black churches. You could argue to intimidate them.

Unless they threatened violence, yes. This is stupid. No such thing as a hate crime for passing out literature.

So when a black person giving a presentation on critical race theory tells all the white people in the audience they’re racist and need to atone for their privilege, that’s also a hate crime to you right?

I did read the article, and WGAF how they passed out the pamphlets. Unless the pamphlets were inciting people to harm others, it's still free speech.

They taped the papers with swastika and skull to the doors of a black church and a synagogue in an area not dar from Buffalo where people were shot based upon race not too long ago. That is not free speech. That can easily be viewed as threatening.

The behavior is crass and disgusting, but it is (or SHOULD BE) protected. A big part of free speech is "the right to say things that offend others."
Did some city or state pass an ordinance or statute that makes this behavior illegal? Maybe. But it will not survive 1st Amendment scrutiny.

Kinda like Supreme Court protestors and their threats? Will they get the same treatment?
We need calendars passed out to know what days count intimidation and which days count as protesting.
And nooooo. I’m not saying passing out hate literature is ok. I’m saying we need some consistency and we need it right freaking now.

So the alleged crime is aggravated harassment.
So the contents of the pamphlet probably matter. If you drop off something saying all Jews and black should be round up and shot at a synagogue it probably crosses a line out of free speach.

The First Amendment is a major block in investigation and prosecution of a white supremacy group.
Prosecutors were empowered to charge and try large swaths of people in the same case, at the same time, for disparate crimes as long as those crimes were committed in service to the same organization. At trial, prosecutors were able to enter in evidence that may not otherwise be admissible, such as newspaper articles or mob nicknames.
It’s not a written law. It’s a culture.
