Religious Discrimination- Vaccine Related

This week I was terminated from my employer of 6.5 years due to not getting the vaccine. I have always had great performance reviews and have never been insubordinate. I submitted a religious exemption in which they did not even deny it, just simply outright terminated me. I was offered a severance of 14 weeks. What would you do? Accept or try to fight with a religious discrimination case/EEOC complaint? Anyone know of anyone in a similar predicament and currently pursuing litigation over such a matter?

There will be some to come along and claim that asking for a religious exemption is somehow a lie. Even though you stand by your principles and are terminated, to show you were dead serious. Those people are imbeciles, they are unable to think and put things together.

I think it depends on the job market in your field and whether you think you’ll be able to get another job relatively quickly. 3.5 months of salary isn’t a terrible offer to help you in the transition.

They didn't make a decision on your religious exemption request? I'd talk to a lawyer, 90% chance you have a great shot at a lawsuit.

Your employer is supposed to default to the position that you're being genuine. The fact that they didn't even follow up on your request seems illegal.

EDIT: If you want to, I highlighted my wife's religious exemption request where I lay out the law. Click my profile and search the threads I've started and you should be able to find it. But according to the Civil Rights Act of 1964, your employee should assume you're religious beliefs are genuine unless you've given them a reason to doubt your honesty. In short, you're truthful until proven a liar. The fact that they didn't ask any follow-up seems like they're breaking the law. I'd talk to a lawyer.

Never got back to me. Questioned me about it, and said they would review it. Then, terminated. Never an accommodation, or an explanation of why it was denied. Not a final ultimatum.

Not sure how you answered, but something you said may have given them a reason to deny your religious exemption. Not saying they were right or wrong in their determination. I just know the defense I set up for my wife and she got her exemption no questions asked.

I will edit in a link to this post as to what I helped her type up. Give me a min or two.

Maybe I am simple, but you were fired because you didn't get the shot...Not because you were Catholic. You asked them to consider the fact that you were Catholic and they did and it didn't matter and they fired you.

Should it be cut and dry that you ask for an exemption and I as an employer have to grant it?

I understand that. However, the EEOC says a workplace is supposed to try to accommodate you as long as there Is undue hardship… we are working from home. It’s ridiculous. Seems discriminatory to flat out let an employee go without even getting back to them with an accommodation, explanation, or ultimatum of sorts.

I understand an employer can almost terminate you for anything at any point in time. Just looking to see if there was anyone out there in my same shoes or with any knowledge of a successful case against this before dishing out money on an attorney. Seems tough to win, but I could be wrong.

I’m assuming you live in Louisiana. Is this company HQ’d in Louisiana? Have there been others terminated with you?

Did you submit a long form letter on why you disagreed?

Even if you did, they aren't supposed to question you about it.

I would suggest you file a suit if you were indeed fired over this. Can you prove it? Any emails saying that is why you were let go?

They have been very tight lipped about this whole thing. Not sure if anyone else let go, but I know our vax rate at work was 97%, so there aren’t many not choosing the vax. National company.

Nothing in writing about it. Basically, due to unsatisfactory performance regarding their Covid 19 policy is what I was told. The policy states you need the vax to travel or go to events. There have been 2 events in which I could not attend due to this policy. Both in which I asked if I could submit a negative test, so I tried.

Talk to a lawyer, then take the severance, then leave Louisiana and don't look back.
