Legal Advice: GF Credit Card Debt Lawsuit
Posted on 1/10/22 at 2:50 pm
Posted on 1/10/22 at 2:50 pm
She has two lawsuits from Capital One.
She stopped responding to them, so they filed.
Debt is 8k and 3k respectively on two accounts.
The law firm she contacted today offered 6.5k and 2.7k as settlement options.
Any advice would be welcomed.
*Been dating her 8 months

Break up with her. She’s financially irresponsible and doesn’t stick to commitments or holding up her end of the deal.

How old is she? If over 24, I would call this a MONSTER red flag.
But to pay the debt off, take the dave ramsey approach.
How To Deal

Advice is that she needs to pay her debts even if it means getting a second job.

Tell her to get a new job

Call me crazy or maybe naive, but how do people borrow money to buy things and not expect to pay the money back?
It's basically like stealing in my book.

Easy man.
Many millions of people deal with credit card debt.
I think it’s different for each person, but it’s really not that inconceivable when you consider the way these cards work.
Not uncommon to have 0% interest for the first year or two then a huge spike in interest that can spiral into a situation that makes it hard to keep up.

My advice is leave. It’s not your debt and if a girl 8 months in already shows you they don’t keep their word and pay their debts it’s probably not gonna work.

Why did she stop paying her credit card bills?

Considering this is a financial sub-board and the problem isn’t that uncommon you’d think it was somewhat appropriate to ask here.
Thanks anyway. Good luck with the Batman obsession in adulthood.

It’s the money she spent that is not hers.
It’s ethically correct to pay it. If your friend takes money from you and ignore you. You would be ok with it.

What does she look like? I may be able to help.

You're still the one asking strangers to help out your girlfriend with her crippling debt problems.
I'll take a batman picture over your situation every time.

Negotiate the best deal, then pay. Hopefully she's the one paying.
Ramsey has good info on this. He would also echo to proceed in the relationship with extreme caution.

I have been out of the business for many many years, but here's my advice-
If the lawsuits have already been filed, settlement time is over. They will go to court and pretty much get everything they ask for, plus fees and expenses etc. They hold all the power at this point.
The lawfirm she contacted, is it the same firm that is suing her?
If it's a different firm, what's she paying them?
Can she pay those settlements on a plan or will it be due right away in full?
With those settlements, would they still become judgements or would they dismiss the suit?
5 short sentences in OP isn't enough info for anyone to be able to give sound advice.
