But that is irrelevant to an anti-trust case anyway. All that needs to be proven is that the BCS conferences are part of a collaborative effort to exclude the non-AQs from winning a national title. The fact that Florida State and Miami were able to break through 20 years ago is irrelevant because it was done under a system with fewer bowl tie-ins, open TV contracts, more independent teams, and smaller conferences.
While the non-AQs don't have very much access to the bowl system in general, they do have access to the BCS. Schedule has always been important and I think a case could be made that a lot of AQs avoid scheduling them which hinders their access to the CG. But of course the non-AQs never complain about that in any serious manner. Why should Boise have to play and beat more than the 7th or 8th best team in the SEC to justify themselves?
If they want a shot all they have to do is play and beat a worthy OOC schedule. This means at least a couple of teams with serious top 25 likelihood and at least another solid team. That will earn the respect they need from both the human and computer polls. If the quality teams won't schedule them, then that should be the basis of the suit.

All of that is true
Heck just look at TCU - they were a very good team but they played an easy schedule and would have been in teh NCG if Oregon or Auburn had been tripped up
I kinda wish the middle tier BCS schools would find a way to countersue the midmajors - there is no doubt in my mind it is a ton easier to make a BCS bowl as a Boise or TCU than it is as a middle tier BCS school

why did this shift from an argument about money to the title game? typically these suits are about one thing: money
it's really hard to argue they've been hurt economically when a system they don't really contribute to gives them more money. and even if it is found to be in violation of anti-trust laws, where are the damages? this system gives them MORE money than the old system. if we create a hypothetical system where every conference is on its own, they will LOSE money compared to the current system

It would be so hilarious if they win this suit and the BCS goes away, because it will be replaced by to old system. If the Utah AG thinks Utah and Hawaii would have gotten Sugar Bowl bids under the old system he is high.

The AP National Championship can be won by any team. if the majority of AP voters had voted TCU #1, they would have won the National Title.

yeah, there is no official NCAA championship
the BCS just teamed with the coaches poll to create a contractual obligation of ONE historical poll
there is still the other major poll, the AP poll
i don't see where the "championship" argument has legs
