Hahaha, Well of course I'm not him but I do work in the wireless industry. I have to put up with quite a few customers who will ask for a free phone but will not agree to have service for at least a year so the company can recoup the money from the initial subsidy on the phone. That is why there are contracts.
If you don't like contracts then BUY all of your phones at FULL RETAIL PRICE. The retail price of the phone is REAL price of the equipment not the promotional $9.99 price tag. How in the hell would a company make any money if they sold small telecommunication devices with computers built into them without having an agreement of service.

Were you still in contract after five years? Did you ever go and "upgrade" your phone during those five years? If so, you renewed your agreement. If this was pre-2007 and you changed your calling plan you probably renewed also.
If you renewed you agreement and broke it, then you're at fault.
