It is not the percentage of votes with the "opposition" that matters because cases come to the court all the time that get a large majority of agreement from both sides because the case is clear and not necessarily devisive. What matters here is what the landmark cases are and how they vote. Roberts gave us Obamacare - he was the deciding vote.

So when justices get a reputation it is due to the landmark cases and every case in not one.
