No. It is not necessary for that to be mentioned. That's an entirely different regulatory scheme than the Article 2 powers being referenced.

A little bit of over reaction here……
A local judge issued a ruling , he had no standing to do so, the ruling was to return criminals to USA, the jet was not in the USA when he issued the ruling, the ruling was obviously political and nothing more…….
It was like the back judge saying the player didn’t cross the goal line after the scoring team already kicked the extra point….
