I agree. However that will take time to work through the courts and absolutely will never be ruled upon before the election. It’s a clever tactic by the left, they seek out complicit courts, in favorable districts, to order unprecedented and unconstitutional rulings. The DC circuit is absolutely corrupt, 9th, as is the second circuit, and more.

Appeal to the 11th Circuit

IF (big if) that were to happen, there is almost no chance he could recover any case in time for the November election

Are you an attorney? I like to try and keep a list in my head.
no, however instead of staying in a Holiday Inn... I've faced prosecution from the feds for Sarbanes-Oxley myself (for its intended purpose mind you, not this Trump contortion). So I'm familiar with that for sure.

Trump should sue Garland for breaking the law and violating his constitutional rights
If Cannon rules in his favor on Smith's appointment he should sue Garland (he'll have immunity as per recent ruling- civil and criminal) AND Jack Smith.

Jack Smith will not have immunity; If Cannon rules the appointment violates the appointments clause Jack Smith is a private citizen infringing on the civil rights of Trump (and numerous other Trump associates... 11 other I think?).
Bankrupt him civily with the damages being what every one of these defendants spent on their defense as well as lost wages and any "brand"/reputation defense.

And then, when he takes office after Smith is bankrupted, pursue him through the DOJ civil rights division criminally.

That's exactly what they've been doing to him (and what the Feds always do)- bankrupt you first, then go after you criminally. That's why the EJ Carrol and appraisal cases were first. It was all coordinated from the white house.

With regard to the case in front of judge Cannon, There is a very interesting potential legal argument if Trump wins the election.

Given that he is the next president he can declassify all of the materials in his possession and dust no longer making it a crime. At least that is an argument that I think would hold weight.
