There are about 85K new H1B's issued every year keeping the total H1B population at ~500K. It's roughly a 6yr turnover rate. So virtually 100% of H1B's would be subject to the $100K by 2031.

If the existing H1B holders already in USA. Decide not to travel outside the country, then they will never be subjected this fee.

I have no idea what you mean by "they will just wait it out" until the next president. You cant just wait it out when your visa has expired, well unless you want to do that waiting in El Salvador.....

Once you are already working in United States with an H1B visa, every 3 years that Visa expires and you need to renew it. You can do the renewal sitting within United States and that gives you a paper which allows you to continue to work. You basically maintained H1B status without having a H1B Visa. Only when you exit USA, before coming back, you need to go to a US consulate to get the the Visa stamp based on the extension that you have already received with the USA. So people will simply not get a Visa stamp and not travel outside the USA. Since this this $100K business applies only at entry points, current H1B holders wouldn't pay it if they don't travel outside USA.

Doesn't matter at the end of the day. Most h1B Indians are in software development. AI is basically replacing them. They knew it was coming.

Should have raised minimum salary for H1B

Yes! And then tie it to CPI or something like that. And then go hard after the shady consultancies doing shady stuff to skirt the rules. If, when caught, companies can make everything go away by paying a hefty fine, which when compared to their annual revenue is a pittance, companies will continue to do that.

That is peanuts to this group

I said this earlier. Needs to be 2x the median salary for the position and needs to apply to current H1B visa holders annually.

Why? I love it here.

Plus, when I became a naturalized US citizen, I had to give up my Indian citizenship by paying a fee to the Indian government (I am not joking).

Haven't gotten the OCI card (sort of Indian version of green card) yet. My americanness has kicked in already and I've gotten too lazy to complete all the extensive paperworks.

Immigration is for people who want to be Americans.

If people want to still be whatever country their from, then they shouldn't Immigrate here, they can stay on a guest worker program.

And it doesnt matter if they are Brits or Germans, Indians or Chinese.

America is for Americans.
Its about becoming and American and only an American.

Yes, but this proclamation does not shut it down.

Yes the language in the EO is vague on renewal, but that can be easily changed with yet another EO. I would not celebrate yet.

The not being able to leave the country is a big deal for Indians here. Most hoard up their PTO for multi week trips back to India. Family is a big deal to your country and that just got removed as an option.

I assume all travel outside of US is off the table now.

As long as the EO is in place, it will be a slow death to the Indian culture here. While H1B want to bring their ways here, the US born offspring of Indians embrace American culture. It is only their parents keeping them in Indian ways and each generation is less. The EO would only need to be in place for a decade to de-india most of dense areas.

If it weren't for American based companies, and American's innovation, where would they be? Is their any ideals/ companies in India that haven't been stolen from us? 1.5 Billion people and they haven't come up with anything like Microsoft, Apple, Google, Amazon, etc...They can't even compete with Japan that has had a lot of American influence since WWII.

The BBC is reporting the fee is annual as well as many other news sources on X.

Is it annual or not as the OP proclaims?

Edit: To add current AI summary;

No one knows for sure. Howard Lutnick said one thing during the the actual signing of the proclamation, and the actual text of the proclamation said something else. We will probably not know the details until mid next week.

This is true. Those who are on H1B visa and are out of the country right now are fricked. No one knows if it is around 10,000 people or around 50,000 people. Many Indians in USA, especially those who do not have kids in schools, prefer to travel back to India around this time of the year. Primarily because festivals like Diwali are coming up, and flight ticket prices are lower now after the busy summer season, and more busy Dec-Jan season.

As I said in the original post, I was on H1B. In fact, I was on H1B for more than 12 years. I am not on H1B any more. I am a naturalized US citizen.

When people on H1B get laid off they have 60 days to find another job and transfer their H1B to the new employer. Currently, people in that situation who can't find a new job within 60 days typically request a change of status to a b Visa. Depending on how long departments of State takes to process that request, this can buy someone anywhere between 6 to 9 months. I think the line in the proclamation related to Secretary of State providing guidance.... Is related to that.

Well said, SlayTime. To further elaborate, it seems you’ve not just made it to America, but America’s crown jewel, the great State of Louisiana. So step it the frick up, because from up in Monroe, through Alexandria, all the way down to Slidell, as you’ve probably noticed, we breathe, eat, live, shite and piss excellence. From our roads, to our education system, to our economy, to our physical health, we accept nothing but the best, or somewhere between 47th and 50th best. Slack off and we’ll run you the frick off. Or you can succeed, in which case you’ll probably leave as fast as you can anyway!
