That one is complicated. It's given, because of laws stating that children in the US must attend school. Truancy laws, and all that. As they Have to attend school, the 14th amendment equality protections are in place.

Thank you for the concise and factual response. Does suggest that it is appropriate for DOJ and others to interpret and if others disagree they can sue for relief and have the courts reverse or reassert or clarify.
Likewise leaves room for congress to actually act and pass legislation to define and clarify, though they probably won’t
