When the federal courts use the reconstruction amendments to overrule the democratically decided will of the people it feels so offensive because we are taught to believe that in the American system the will of the people should rule. But 150 years ago when the reconstruction amendments were passed, the specific intention of the radical republicans who conceived them was to allow the federal courts (and the liberals they would appoint to the federal bench) to enforce the will of the northeastern liberal elites on the country. They are anti-democratic by design, and they are working as intended even today.

It was always going to be tough when an area the size of an average US state has 18 Senate seats.

That’s why they threw a hissy fit over the de facto ending of the VRA earlier this year.
