You’re correct, legally no, they didn’t.
But the class structure was the same. And the plantation owning class operated as an untitled aristocracy, with political and military obligations.
In the Union and Confederate armies, low level officers were elected, and the Confederates invariably chose members of the aristocracy for example.
It wasn’t remarked on. It was just understood.

Being as most landowners became officers in the CSA (my ancestors were among that group), it was a defacto policy if not de jure.
