Paramount/CBS: $16 MILLION to Trump for the 60 Minutes election interference hit job. No apology — but they still paid.

Fox News: $787.5 MILLION to Dominion.

Newsmax: $67 MILLION to Dominion. Plus another $40 MILLION to Smartmatic.

CNN, NBC, Washington Post: ALL settled with Nicholas Sandmann, a high school kid they tried to destroy.

The pattern is unmistakable. When forced into court, the media doesn’t defend its “journalism.” It writes checks.

t created the “actual malice” standard: To win a defamation case, a public figure must prove the outlet KNEW the story was false or acted with reckless disregard for the truth.

Sounds reasonable? Here’s the trap.

“Reckless disregard” doesn’t mean sloppy reporting. It doesn’t mean ignoring exculpatory evidence. It doesn’t mean running with a narrative because it fits the agenda.

In practice, it means you need a clear internal memo that says, “Let’s lie today.” Which never exists. Because they’re not stupid — they’re protected.

The result? Six decades of consequence-free character assassination.

quote:

Thomas wrote that the actual malice standard has “no basis in the original meaning of the First Amendment.”

Gorsuch went further — pointing out that in the modern era, the Sullivan shield doesn’t protect courageous journalism. It protects click-driven outrage factories that can “destroy a person’s reputation with a single tweet.”

Their words: The current standard can “protect lies instead of truth, with real-world consequences.”

Two sitting Supreme Court justices. On the record. Wanting to revisit the entire foundation of media immunity.

When Sullivan falls — and it’s now a question of when, not if — the entire industry’s business model collapses overnight.

And yet.

ABC didn’t fight. They paid $16M AND apologized.

Paramount didn’t fight. They paid $16M without an apology, but they still paid.

Fox didn’t fight. They paid nearly $800 MILLION rather than let a jury see the evidence.

Why?

Because discovery is the nuclear option. Depositions. Internal emails. Slack messages between editors and reporters. The sausage-making exposed to sunlight.

They’ll pay anything to keep that hidden. The settlements aren’t admissions of guilt — they’re hush money to keep the machinery invisible.

The truth isn’t in the settlement amounts. The truth is in the fact of the settlement itself.

quote:

The same white-shoe law firms represent every major media outlet. The same insurance companies underwrite their liability policies. The same social circles connect judges, media executives, and the lawyers who sue them.

It’s a closed guild. A revolving door of influence where the people supposedly policing journalism are the same people who are journalism.

When a defamation plaintiff walks into court, they’re not facing one outlet. They’re facing an interconnected web of institutional power that has spent 60 years perfecting the art of never losing — or, when losing is inevitable, burying the evidence in confidential settlements.

The Sandmann case is instructive. CNN, NBC, and the Washington Post all smeared a teenager. All three settled. All three kept the terms confidential. The public never saw what was in those discovery files.

That’s not a bug. It’s the feature.

TWO: Support plaintiffs who fight. The Sandmanns and Trumps of the world have resources. But every time a smaller plaintiff wins or forces a settlement, it builds precedent and drains media war chests.

THREE: Demand anti-SLAPP reform. Current anti-SLAPP laws were designed to protect citizens from being sued into silence. Media corporations now abuse them to recover attorney fees from good-faith plaintiffs. That needs to end.

FOUR: Starve the beast. The most powerful weapon isn’t legal — it’s economic. Every canceled subscription. Every blocked advertiser. Every person who stops watching. Legacy media is dying because Americans stopped trusting them. Accelerate it.
quote:

Section 230 currently shields platforms from liability for what users post. But when platforms algorithmically amplify content they know is false, they’ve crossed the line from neutral platform to publisher.

If Section 230 were reformed — or repealed — to treat algorithmically boosted false content as publisher activity, the entire social media censorship apparatus faces existential legal risk.

Facebook, Twitter/X, YouTube — they don’t just host content. They actively promote it. They decide what goes viral. They shadowban, suppress, and throttle based on political considerations.

If that activity loses its legal shield, the liability floodgates open for platforms, not just traditional outlets.

This is why they’re fighting so hard to keep Section 230 intact. It’s not about free speech. It’s about immunity for editorial decisions they claim not to make.

?? 8/8: THE BOTTOM LINE

The media’s immunity was never about the First Amendment. It was about power.

The Founders didn’t envision a world where a handful of corporations control the entire information ecosystem. They didn’t envision algorithmic amplification, shadow-banning, or coordinated narrative management across supposedly “independent” outlets.

They envisioned a raucous, messy, competitive press held accountable by the threat of defamation lawsuits when they lied.

We’re finally returning to that vision.

The settlements are piling up. The Supreme Court is signaling. The public trust is gone. The economic model is collapsing.

The lying press had a good run—six decades of near-total immunity to destroy anyone who got in their way.

That era is ending.

And they know it.

Hold the line. ??

I wish, but

quote:

The U.S. Supreme Court has not scheduled or signaled any plans to reconsider New York Times v. Sullivan, having most recently declined a direct petition to review the precedent on June 29, 2026.

Current Status of the PrecedentRecent Petitions Denied: The Court turned away a direct challenge to the ruling in Dershowitz v. Cable News Network, Inc., leaving the actual-malice standard intact.

Broader Support: A majority of the justices have continued to cite and apply the core principles of Sullivan in related First Amendment cases, making wholesale reconsideration unlikely in the near term.

Prior Calls for Review Individual Justices: Justices Clarence Thomas and Neil Gorsuch have previously written opinions questioning the 1964 framework and urging the Court to revisit the actual-malice standard, though they have not garnered the votes needed to grant certiorari on the issue.

As they should be. If they verified information instead of publishing shite ASAP for clicks, they wouldn't have to worry as much.

This is really going to change the world we live in if the activities of all are truthfully spoken. Obviously they had a good run.

Then Elon said, "Hello". An autist has no time whatsoever for what is false.
