The Dormant Commerce Clause is a legal doctrine inferred from the U.S. Constitution's Commerce Clause. While the Commerce Clause explicitly gives Congress the power to regulate interstate commerce, the doctrine implies that states cannot pass laws that unduly burden or discriminate against out-of-state economic interests, even if Congress hasn't passed conflicting legislation

They don’t unduly burden them. Florida has to cover the liability of illegally licensed drivers causing wrecks and deaths and needs the funds to cover that liability.

The fact that it's nonenforcement makes it more difficult, though, b/c it's asking the feds to act. Preventing the feds from acting illegally is much easier (like TROs)

Frankly, I am a little surprised that the FTC hasn't swooped in on this. Seems like a political no brainer.

As I have typed in this thread I have thought the same thing.

This is the lowest of low-hanging red meat AND this just opens the door for DEMs to act retarded and turn off moderates.

Only the feds can do this. Even if they got this declaratory judgment, the feds still have to execute that judgment.

Agreed on this. So wouldn’t that fall under the jurisdiction of the SC?

Why wouldn’t they take up a case on behalf of States for a federal issue?

Because it's not a claim that Florida can legally pursue

In Louisiana was call it a "right of action" but not all states use our language.

The feds are the proper party with the right to take up that case and file suit

Interstate commerce to include transportation is now nebulous.

Interstate commerce is also the domain of the feds.

"Interstate commerce" is whatever the government wants it to be, at this point.
