Thanks for bringing the separation of powers issue front and center.
All of the judges will have to recuse since they appointed him.

The left and the DSA fundamentally do not understand our constitutional system of government. This is why they want to abolish the Senate and the Supreme Court.
The DoJ is part of the executive branch. The president has the power to fire executive branch officers and to make temporary appointments pending confirmation from the Senate.

Same shat as happened in Virginia.
Committee approves and it goes to the senate floor for vote. But they wont because the senator from that state pulls the ole blue slip nonsense. So then its up to the judges to decide who they will "argue" with. So Trump fires him as soon as they pick him.
All could be avoided if Thune let them recess and Trump could appoint. POS.
And the entire senate for this nonsense blue slip crap.
Now watch, he will appoint a temporary and a judge will pull a Boasberg, same shat as Virginia.
They cant stop it, but they can run out the clock.

Not just that, they want to abolish the Constitution outright and replace it.
