Whether there is provocation by Kyle for jury to consider on some of charges.

Legal nonsense that should be trumped by common sense.

Judge needs to get control of this. The longer this drags on the worse I feel.

Then he can't despite supposedly reviewing this footage dozens of times. Which just proves it should not be considered evidence of the state's case.

Rekeita is talking about this moment's importance

if this particular jury instruction they're talking about and this video is key to is thrown out of jury instructions... it's Rekeita's feeling there's NO WAY Kyle gets convicted on anything

The prosecution is trying to convince the judge that this video shows Rittenhouse pointing his gun at Mr. Ziminski and that is provocation for the child molester Mr. Rosenbaum to charge at Mr. Rittenhouse.

Seems like a pivotal point. Apparently provocation moves the goal post on self defense and could help some jurors rationalize in their heads KR brought all of this on his self.

Yes, this is why they are having a big fight over this. Without provocation, the prosecution knows they are fricked.

If the judge can't see anything, there is no way the jury can find beyond a reasonable doubt that this occured.

And even if they do think it occured, that doesn't mean its not self defense.

This is a joke.

They need provocation by Kyle to remove the self defense claim.

Without this vid that the state claims shows Kyle pointing his gun at Ziminiski, which no can say for sure it does, they have no way of showing Kyle provoked the attack.

Rosenbaum was already provoked when he left that mental hospital.

The judge is running a circus. The defense should be objecting to the whole thing.

Defense counsel hasn't objected at all. (crazy)

Judge bringing up the prior threats by Rosenbaum to Kyle beforehand. Fatlock looking flabbergasted and stumbling his way to reply. Looks like the Judge isn't convinced.

I can't believe the judge is letting Fatlock keep this charade going.

What are you talking about? They are, that's the discussion.

The jury isn't in the room.

Let me make sure I have this straight...the prosecution is arguing that Rosenbaum started yelling "Gun! Gun! Gun!" due to Rittenhouse raising his gun and ignoring that Zimenski had just fired a shot into the air seconds before that? Is that right?
