Because there is already a suit pending in New York based upon the same alleged actions and occurrences...which would lead to....wait for it.....JOINDER.

So what were the actions and occurrences in each suit so that the joinder issue can be addressed. You should already know them since you were so sure the D.C. case couldn't be filed.

If the merits of their case were so strong they would have chosen the correct venue rather than trying to “gamemanship” their filing. Glad the presiding judge was ethical in the conduct of his duties.

If a judge dismisses for improper venue, and does not make a decision on the basis of the merits of a case, the plaintiff is still free to file in the appropriate venue. Suit was nothing but a stunt. If they were serious they would have actually worried about selecting the proper venue. Nobody is refilling anything here.
