This was such a masterful move by President Trump he let Kavanaugh take one for the team last time, so he could hold her back just in case he had to nominate a justice late in the game. He anticipated this and knew she was going to own the proceedings like she is doing.

Elena Kagan was directly involved in defending the ACA in courts and she didn't recuse herself in Sebellius. Why in the world should she recuse herself in any potential election related case because she was appointed by the President?
