I believe there are over 1.5 million non profits in the US now. Talk about where the IRS should have been focusing. The problem is the IRS mentality of thinking, even if it is non profit, the money paid to the organizers will be captured on their income tax.

What this has created is this whole massive movement of mini clinton foundations. If the "foundation" owns the planes, penthouses, etc for "business use", the people who have the non profit can live a lifestyle anyway they want tax free......with no cost since the govt is paying for it through "grants".

I read a law review article on that last night, and the closest one is the "Grants", but that means the individual grant decision (so each agency doesn't have to go through the APA every time they make a grant decision).

The issue the admin is going to have is that they're making a broader policy choice across multiple agencies, not making individual decisions on how grants are distributed. That's policy making.
