H1B visas have a legitimate function. If there really aren't enough people to do a job we import them.
The fee is to make sure they can't offer starvation wages and then try to claim they can't find anyone. Raise the cost of the H1B enough and there's no benefit to the scam. They won't import unless they legitimately have to.

That was struck down by the courts last month or so. This is a new rule and is more encompassing than last year's. Another difference is this is a formal rule through DHS whereas last year's was just a Presidential Proclamation.

They already have to do a labor cert through DOL, they could have already cut that part out by denying the labor certs for the companies instead of rubber stamping approvals (99% approval over the last 4 years).
Trump already tried the $100k fee and lost last year, not sure why this will end up any differently.
Instead of fighting more litigation, the better strategy is to just deny the labor certs, but that isn't flashy and easy to put on X.
