I hate to say this but technically he is right about the language in the oath. I mean, just read it.
The problem is what would happen if the President went goo-goo headed and ordered something completely crazy. Killing Jews, the beheading of gay people etc.
That is why the oath also mentions the faithfulness to constitional norms.
It's just another of our checks and balances in this land.
