Not sure. I didn’t even know it was an option. Thought if it failed, Kav was done for sure. Proud LG would continue to fight the darkness.

Does this mean he thinks the votes are not there to confirm?

No, he was very confident. Hannity just threw his “what if” out there.

I’ve noticed his flamboyant multicolored coat lately, and I like it.

You're taking appeal as a legal or procedural mechanism which is not what he meant.
He's saying if Kavanaugh got voted down he would "appeal to" aka argue to Trump, to state from his bully pulpit that he intends to nominate Kavanaugh again. If the American people want Kavanaugh, they will vote out the senators that voted against his confirmation during the midterms. Then, presumedly, Trump would nominate Kavanaugh and another vote by the Senate would take place.
There's no rule that a potential Justice who is voted down cannot be renominated as far as I know.

Thanks for the clarity. Didn’t know they could be renominated.

Nope. And, there is no rule that cannot be suspended by the Senate Majority Leader that would require the new nomination be sent to the Committee on the Judiciary. It could be moved straight to the floor, debate, cloture vote after attempted filibuster, vote on the nomination and voila new associate justice.

He says if they fall one vote short, he will go to Trump to appeal and a vote would go out to citizens? This is beyond my Civics I knowledge.
Here is what he means.
1. Let's say Kavanaugh is not confirmed by a one or two vote margin.
2. Remind the voters in the red states who had Democrat senators up for reelection who voted no on Kavanaugh exactly what those senators did over and over from now to the midterms.
3. Hopeful result will be a net pickup of two or three seats in the Senate for Republicans.
4. After the new Senate convenes in January renominate Kavanaugh under the theory that the new senators would be yes votes replacing the one or two no votes that kept Kavanaugh from being confirmed before the election.
It's not a direct vote by the citizens but the citizens can affect the vote indirectly by voting out a few of the no voting senators and replacing them with senator who assumedly would vote yes and then go through another round of hearings on Kavanaugh ending with another vote. Only downside would be that a Democrat senator who votes yes for Kavanaugh now and wins reelection could then vote no for Kavanaugh after the next round of hearings because the voters would have six years to forget about the vote before that senator is up for reelection. Mancin would probably be the only one this could apply to though.
