If u assault someone in ga how long can they wait and press charges. Accident occurred 9 yrs ago thanks figured the sofisticated people post here

Assault is not an accident. Not an attorney but 1) look up your state's statute of limitations and 2) does new evidence restart the limitation.

Consult an attorney and not a message board. Geez!

If the accident is assault, not sure how unless you bumped into them accidentally, the statute has gone bye bye 5 years ago but I’m interested in what accident is considered assault ?

Civil assault by definition can't be accidental (which is what I thought OP was talking about originally) but for criminal assault, apparently Georgia has this caveat which could make it 'accidental' in theory

(a) A person commits the offense of simple assault when he or she either:
(1) Attempts to commit a violent injury to the person of another; or
(2) Commits an act which places another in reasonable apprehension of immediately receiving a violent injury.



PA doesn't have this, or at least it's not written this way. Don't know anything about GA case law on section B so it could require intent, idk

ETA: clarification- original was confusing with civil/crim distinction
