A Montana judge handed a significant victory on Monday to more than a dozen young plaintiffs in the nation’s first constitutional climate trial, as extreme weather becomes more deadly and scientists warn the climate crisis is eroding our environment and natural resources.

In a case that could have legal reverberations for other climate litigation, District Court Judge Kathy Seeley ruled that Montana’s continued development of fossil fuels violates a clause in its state constitution that guarantees its citizens the right to a “clean and healthful environment.” Montana is one of several states that have explicit environmental guarantees written into their state constitutions.

While Seeley’s ruling won’t prevent mining or burning fossil fuels in the state, it will reverse a recently passed state law that prohibits state agencies from considering planet-warming pollution when permitting fossil fuel projects.

It is also a landmark win for young climate advocates who are turning more to the courts for judgments on the causes and impacts of the climate crisis.

quote:

The Montana attorney general’s office will appeal Seeley’s ruling to the Montana Supreme Court, Emily Flower, a spokeswoman for Attorney General Austin Knudsen, said in a statement.

“This ruling is absurd, but not surprising from a judge who let the plaintiffs’ attorneys put on a weeklong taxpayer-funded publicity stunt that was supposed to be a trial,” Flower said. “Their same legal theory has been thrown out of federal court and courts in more than a dozen states. The State will appeal.”

We could argue all day about whether including this language in the state constitution constitutes good policy, but (given that it IS there) is the ruling entirely unreasonable?

Idiot ideologues will have us all cold, hungry and in the dark if they are allowed to.

The entire "severe weather" claim was itself a lie from the political summary of IPCC AR.4 that is contrary to the actual scientists conclusions.

I've been arguing with the climate freaks for years. Currently arguing with them on youtube about the wet bulb - as they think everyone is going to die at a wet bulb of 94 and so on. I'm just tired of their lies and propaganda. They have passed the vegans for worst group ever. It's a cult and a religion mixed into one.

What did the ruling do?

Sounds like the problem here was the state legislature ignoring its own constitution.

Notice how progressives use kids for props on every major issue?

They certainly did with the transgender issue, it became their central focus. Now they are badgering kids into climate activism.

No shame.

Lawyers and "the law" will add to the death of this nation.

What is the point HAVING a Constitution, if the legislature can just ignore it.

The limitations of a constitution upon the whims of the legislature are the VERY POINT of having a constitutional republic.

I know a document that says

secure the Blessings of Liberty to ourselves
.

We need to release those we hold captive then.

Critical Race Theory was borne in law schools. The courts are where the meek will seek their retribution..
