This is clearly Abbott defiantly working against clear case precedent. Maybe it's OK because practically it shields an ICE agent from a Minnesota lynch mob jury, but it will be REALLY interesting to see if other governors start following suit.

Of course, at this stage, that's just what Minnesota alleges. The video shows that Castro was lying about the justification for the shooting. ICE has found that he lied about it.

Minnesota will appeal and this could end up being one of those "first impression" cases because the logical argument I would see Minnesota making is "how long " can a Governor deliberate. At what point does "I am still investigating" really mean "I refuse"?

Agree. I wrote my Masters Thesis on Rendition of Fugitives from Justice.
In the dozens of cases that I reviewed, not once did a governor slow roll the Rendition Demand. I have to admit Abbott's team is creative, albeit completely dishonest.

I'm not giddy. I am just amazed and amused that a governor would be counseled to just lie about this.
Probably stupid to try to reason with you. You want laws applied to fit outcomes. I (and I suspect Jim) want the law to be followed...irrespective of outcome.

Is the ICE internal affairs investigation still ongoing? Has he been fired from ICE for this event? If ICE did an investigation and the claims are confirmed, I would expect Abbott to send him back. Maybe that is what Abbott is waiting on.....I looked it up, ICE has not yet issued a formal final conclusion of the event. Is he on paid/unpaid administrative leave pending outcome of investigation?

I didn’t insult your education/intelligence. It's just that you have a different perspective on the application of the law.
Legally, I hated the bogus New York prosecution of President Trump because of various abuses of the legal system. I hated the bogus perjury prosecution of James Comey for the same reasons.
Politically, I am a Christian worldview supporter. The Republicans are the best hope from that perspective. Trump is the greatest president of my lifetime (NOT because of theological reasons). J. Bennett Johnson was the last Democrat for whom I voted.
You can't cite a single time I have supported a Democrat politician or policy...because that hasn't happened since I joined this Board in 2020.
I guess you just think anybody who disagrees with you on ANYTHING must be a Democrat...even if the subject isn't political.
Name a policy that you think you and I disagree about....that makes me a Democrat and you a Republican.

Those are good examples - I am not dismissing them - but neither Carpenter nor Coeytaux had physical presence in Louisiana. Therefore, unlike the case in Texas, there is no question that these two people are not "fugitives from justice" under Article IV.
Federal law allows Governor discretion in cases like these. The Louisiana cases are governed by UCEA § 6 not Article IV of the Constitution. there is no discretion in Article IV cases, there is discretion in UCEA cases like the two you bring up.

I wrongly assumed that physical presence was not a requirement to be deemed a fugitive from justice in cases regarding the shipment of drugs. I appreciate the correction.
