Its called spoliation and is commonly asserted in civil litigation to demand that evidence shich would potentially benefit the plaintiff not be destroyed and preserved in its present form However, if Brennan does not have a n open lawsuit to attribute the demand to it seems far too expansive to expect a potential defendant to preserve anything without knowing what they may be defending, Of course with the way the federal judges are at war with the Trump administration anything is possible at that level and it may take an appeals court or the Supreme Court to stop it.
