If he is elected by a majority vote in the House of Representatives, he can. There is no requirement that the Speaker has to be an elected member of Congress.

Under current house rules, no.

No one can serve in leadership while under felony indictment that could result in 2 or more years in prison.

Why would anyone want the man as speaker?? He couldn't assemble an effective white house staff. We have learned of his disdain for wounded vets, POWs and soldiers buried at Arlington. We know he lied about the the trade war goals, the White House papers in Florida, his relationship with Fauchi, even the attendance at his swearing in. His family does not support his politics.

Why would anyone want him for any office??

You do realize that House Republican Conference rules would prohibit him from serving in the post.

Familiarize yourself with Rule 26(a)

They enforced it on Tom Delay back in 2005. If they lifted it for Trump they would be seen as hypocrites.

Nope everyone knows the prosecutions are BS.

For some reason he doesn’t want it though. Not sure why - seems like he could terrorize Biden, Pelosi, and Schumer quite a bit.
