And the prosecution didn’t seek out even one firearm expert to refute the defense who did have expert testimony

For someone so sure of how the case should have turned out you seem to know very little about the actual case and its testimony. The prosecution's key witnesses were their firearms experts.

"John Evans was brought in as a witness because of his experience in ballistic and firearms investigations."

"Gerald Andrew Smith, a firearms expert with the San Francisco police crime lab, testified today in the trial of Jose Ines Garcia Zarate, a 45-year-old homeless Mexican citizen being tried for second-degree murder in Steinle's death."

He stole the gun that’s a felony

There was no evidence found that Zarate had any link to the break in of two cars where the gun was stolen along with a computer and other items. Investigators also found no evidence of Zarate ever possessing the other stolen items or trying to pawn them.

Yeah it just magically appeared.

7 time felon in possession of a stolen firearm shoots someone and it was all just a really weird series of unfortunate circumstances

I read the expert testimony was called by defense which I thought was strange. My bad. Doesn’t change the underlying facts. This was not aggressively pursued save for the charges they went for knowing what they had wasn’t enough

It smells like shite.

And intentional

The bullet ricocheted off the ground before hitting the victim in broad daylight in front of scores of people walking around. Yeah, it was "intentional." He was trying to murder a woman he'd never even met in front of scores of witnesses.

Here's a guy who shot and killed a person he was actually aiming at, and even HE'S only being charged with manslaughter:

"A New York man now faces a charge of second-degree manslaughter after an incident late last month in which, authorities said, he shot and killed a neighbor he mistook for a deer.

On Nov. 22, around 5:20 p.m., 43-year-old Rosemary Billquist was shot once in the hip by Thomas Jadlowski from some 200 yards away as she was out walking her dogs in a field near her home in Sherman, New York, according to officials with the Chautauqua County, New York, Sheriff’s Office and the state’s Department of Environmental Conservation

What about him being a felon in possession of a firearm?

The prosecutor gets to decide what underlying criminal action to apply. They chose to NOT use this one

From what I've read, felon in possession is usually the first charge to be plea-bargained away.
