Trump sued O'Brien for defamation some 15 years ago. Trump's returns were relevant to that case, and O'Brien sought them in discovery. Trump fought tooth-and-nail against producing them, but the Court eventually forced Trump to make the unredacted documents available to O'Brien, at which time O'Brien and his attorneys reviewed them in detail.
That civil suit was completely unrelated to the current criminal investigation.

The accountant is only responsible if he deliberately files a false return. The responsibility for giving correct information is on the taxpayer.
