"How Strong Does the Evidence Against Kavanaugh Need to Be?"

Even if it wouldn’t support a criminal conviction or civil liability, a merely credible allegation is enough to disqualify him.

So what standard should the Senate use in evaluating the claims made by Dr. Blasey and in deciding how they bear on Judge Kavanaugh’s fitness for a seat on the Supreme Court? The Senate’s approach to its constitutional “advice and consent” obligation has always depended on context. A number of factors matter: the timing of the vacancy; the justice being replaced; the nominee’s likely impact on the ideological makeup of the court; even the popularity of the president (very popular presidents have always had more leeway when it comes to picking justices). Then, of course, there’s the nominee.
This coming from ex-Obama White House lawyer. Is this the official position of the left now: "Even if the allegation against Kavanaugh is a lie, he should be disqualified."

I love the whole “even if it’s not true, he should be disqualified” argument.
How in the hell does that make any sense?

And these people actually think they're the smartest people in the room. Liberals are the most illogical creatures walking the planet.

If you can’t meet a preponderance of the evidence standard in a civil case, the accusation isn’t credible.

Part of me hopes they're successful so we get one of the extremely conservative female judges on the bench and Repubs can use this later.

This should never be a factor in the decision. The application of constitutional law must always be the prime criterion.

The former President used his position of power to obtain oral sex from an intern.
He also was accused of numerous other rape and sexual assault allegations.
He retained the most powerful position in the world.

That's good and well, but midterms must go according to plan.

The longer the Dems let this play out, the more likely a Red Wave becomes.

Beyond a reasonable doubt.

if that is the new standard, then anyone can be disqualified
we have technology now that can make up photos or even videos that seem incredibly real of someone saying something they did not say

Judicial activism is the only way to impose their ideology on the public, since they can't do it at the ballot box.

Just saw that in addition to being one of Obama's White House lawyers, she is the wife of MSNBC's Chris Hayes. All-in.

Yeesh, that’s a law professor saying that. Leftists are absolutely deranged. Without exception.
