Local PA CBS site.

quote:

It declares that the stay at home orders were unconstitutional — should never have happened, that the business shutdown orders violate two sections of the U.S. Constitution and picking winners and losers shall not happen again in Pennsylvania under these circumstances,” King said.

U.S. District Judge William Stickman IV, an appointee of President Donald Trump, sided with the plaintiffs. Stickman wrote in his ruling that the Wolf administration’s pandemic policies have been overreaching, arbitrary and violated citizens’ constitutional rights.

I have been wondering how a governor can just order businesses to shut down. Seems like you need laws.

And all other states will follow.

You cannot take away a person's livelihood. Period.

I've been wondering how these emergency orders have gone on so long. The whole point of them is that there is not enough time to get the legislature together.

We're almost 7 months into this pandemic.

A little late for all this.

It could be helpful for future shutdowns. A ruling like this will make Governors rethink their orders. The hope would be it affects their decisions

Agreed. What took so fricking long?

The government should not go beyond making recommendations. People and business can choose to follow them at their own risk.

"Executive Orders" that have been stretched way farther they actually have the Constitutional right to execute.

I have a cousin who lives in PA with his wife and two daughters age 2 and 6 months. They have not left their house since March. Not even to go to the grocery store(they have it delivered). He wouldn't even go to his brother's own wedding where he was supposed to be the best man. My aunt told me its because his wife is terrified of her kids dying from COVID even though there is no documented case of this happening worldwide.

When FL opened bars/breweries then shut them down again, they let ones that obtained a food license to continue to operate. Apparently COVID doesn’t spread if you order food with your beer. Just a scam to get more money from the license applications.

Can any lawyers here tell me how this ruling compares to Judge Martin Feldman’s ruling in New Orleans recently which validated JBE’s executive orders shutting down the state?

This is will obviously be a contested ruling.

I’m at the point where old people or people who are scared should just stay at home

Everything else should go back to normal. The people that are vulnerable or who are just scared to breathe should bear the brunt of a lockdown. These people should not be making g everyone else be miserable

There is just no data that this is devastating to healthy people or young.

Butler, Fayette, Greene and Washington counties — and some Republican officials like Congressman Mike Kelly and state Reps. Marcie Mustello, Daryl Metcalfe and Tim Bonner — filed a lawsuit against Gov. Wolf and Secretary of Health Dr. Rachel Levine.

quote:

Dr. Rachel Levine Bio

Dr. Rachel Levine is the Pennsylvania Department of Health Secretary, she previously served as the Physician General. She is also a professor of Pediatrics and Psychiatry at the Penn State Milton S. Hershey Medical Center. She is also the chief of the Division of Adolescent Medicine and Eating Disorders.

quote:

Rachel Levine was born Richard Levine before she transitioned.

quote:

Rachel attended Belmont Hill School, Bellmont is an independent school for boys. She later joined Harvard College for her undergraduate studies. In 1983 she graduated from Tulane U, School of Medicine and specializes in pediatric medicine.

quote:

Rachel was born a man but she transitioned and began identifying as a woman in 2011. According to the Washington Post, she started seeing a therapist in 2001 and at around 2008 she started to grow out her hair before publicly announcing herself as a transgender woman. She took voice lessons to sound more like a woman. Rachel, however, doesn’t like to discuss whether she took hormones or had surgery as she calls it a private medical matter.

The Pennsylvania Secretary of Health recommended continued shutdown order of businesses appears to be very politically motivated.

Are you talking about our version of Mrs. Doubtfire? I live in a purple county with extreme left and right here and everything in between. The shutdown here is 100% political at this point. I’m exhausted of it.

What I find absolutely crazy is so many of these liberal suburban women talking about Covid this and that and their nice “Stay the fu%# home!” Captions on their Facebook photos and then I see their entire family at the soccer fields yucking it up with their other Biden supporters and posting photos with backyard wine parties. The second I suggest our schools open back up to students in person I’m a racist anti science POS.

It’s maddening
