It's convinced a lot of Judges so far. I don't think it's a bad argument at all, I just don't think it carries the day.

Democrats have moved from believing slavery is good to believing that putting Japanese Americans in internment camps is good to not allowing Muslims from some countries into our country is bad.

If they hold that, I guarantee you it won't be a true per curiam. It will be a bullshite per curiam where the majority doesn't want to take ownership of it accompanied by dissenting opinions.

In the grand scheme, this is actually a huge win for Trump. The 4th Circuit, on its own, reinterpreted the meaning of Supreme Court precedent, radically extended establishment clause jurisprudence, and held, for the first time, that a candidates statements can be considered in post-election conduct. That last holding alone has far-reaching implications, because it presupposes that once elected, an official is forever tainted by pre-election statements and can't be cured.

Trump couldn't have hoped for a better case to invite Supreme Court review. He got exactly what he wanted.

Two appellate circuits deciding the same way, the 4th and the 9th. The Supremes will likely deny a cert petition and let the (so far) unanimous judgment of the courts of appeal stand.

Sigh. A Circuit split isn't the only way to get to the Supreme Court. Don't you think there was a reason these cases were brought in the 4th and 9th an no other circuit?
