Yeah where in that does your rule apply to criminal prosecutions?
Hint: you (and the online content creator who you learned this from) are using the civil standard when discussing criminal SOLs.
The criminal SOL (from your link)
To be more specific, it's 5 years from the last act of the purported conspiracy. When that last act is discovered is not relevant.

The criminal SOL (from your link)
quote:
For criminal prosecutions brought by the government, the statute of limitations is five years. Unlike the civil time limit, this deadline is derived from a general federal statute, 18 U.S.C. § 3282. This law acts as a “catch-all” provision, setting a five-year deadline for any non-capital federal crime where Congress has not specified a different time limit. Federal prosecutors must bring an indictment for criminal RICO violations within five years of the offense.

Thats not how I read it counselor. It merely mentioned bringing a case.I didn't see where the explanation differentiated..
It discussed the statute for civil and criminal cases and THEN talked about when the clock starts.Pretty self explanatory to me perhaps your reading comprehension skills are lacking.

then at least sedition.
How can any act purportedly against Trump be sedition prior to him being sworn in as President?
Until that point he's not, "the Government of the United States", or in any way part of it.

A claim, which is civil.
Just read the case they cite, Rotella v. Wood. Here is a summary
quote:
The U.S. Supreme Court held that the "injury and pattern discovery" rule does not govern the start of the limitations period for civil RICO claims.

... no doubt in my mind, that's for sure ...

An older standard was the “last predicate act rule,” where the clock would restart with every new criminal act.

Yes a civil RICO suit requires a criminal act. Predicate criminal acts are required for all uses of RICO, criminal or civil.
You're still talking about the civil SOL. I literally posted you a summary of the USSC case cite that makes it clear that case is only discussing the civil SOL.

Might be a dumb question, but how easy/what is the process to get the SOL windows changed retroactively like they did with some of Trumps “crimes” and cases?
Posted on 10/1/25 at 10:23 pm to SlowFlowPro
Let's say youre right. Every swinging dick of them are civilly liable.Donald J Trump could and should bring a massive RICO lawsuit against every single one of them.

It would take an act of Congress, but is almost assuredly illegal for criminal cases. The NY law that was changed was for civil suits, not criminal prosecutions.

With the 4-year SOL, Trump would have to argue he "should have known" about them after October 3, 2021. That dog won't hunt, just look at the LINK I posted from 2020. The "should have known" existed at least by that time.

... got it, but I still owe a LOT of people free beers ...
may take a while

As you are gloating and smelling your own farts over your post from 2020, keep in mind that a continuing conspiracy does not have a SOL.
The coup has been happening since 2016-17 and is continuing by actions, statements, lies and deceit by the conspirators.

That's a whole nother conspiracy theory and not the reality we are discussing

Then, tell us that this was all investigated and no wrong doing was found
There's that, too. Will hurt any attempted prosecution. This has already been reviewed by multiple agencies and bodies years ago.
Called it… hahahahahahahahahahaha

We'll see if it will hunt soon enough.
