False. We're having this fight because Trump tried to rescind the standing EO. The courts told him "not so fast".

As far as why the courts ruled in favor of DACA, I didn't read the decision. Presumably it was the opinion of the court that the government can't basically entrap people. DACA recipients had to supply names, addresses, places of employment, relatives, country of origin, etc....there was a thorough background check to be granted DACA status. I would assume the court believes it is illegal for the government to then turnaround and use that information to find and deport people. The government can't just pull a rope-a-dope on people.

What's the difference in deporting DACA folks who have given name, address and background check... and deporting folks who've overstayed their visa who have submitted name, address and background check?

I would assume it's because visa holders know that they're here for a short stay whereas DACA was presented as a means to stay indefinitely and eventually lead to full-blown citizenship.

I'm no expert, obviously, but that seems to be enough to differentiate a court's view on what was entrapment and what wasn't.

You guys are some uninformed mullets. Obama never signed an executive order for DACA. Trump can't reverse it because it was never an EO. DACA was a policy from the Department of Homeland Security.

Obama tried to extend DACA to adult family members of recipients but that is what was blocked by the court. His idea was to keep them from breaking families up from deporting parents and grandparents.

The federal district judge for the Northern District of California and the federal district judge for Brooklyn both issued injunctions to stop Trump from ending DACA.

The White House pleaded for SCOTUS to expedite their review of the case which, had they agreed with Trump's EO to end DACA, would have ended the program immediately. SCOTUS declined the White House's request.

So 2 district judges and the supreme court ruled in favor of DACA staying in place for the time being.

That last part is quite a stretch, but President Carter revoked Iranian student visas in 1979.

They had the rug pulled out from underneath them, and it was completely legal.

The bottom line is this. If you want to hold someone responsible for their plight, look no further than their parents, and themselves.

They have had years and years to address their personal status, they have known they were illegal, and in just about all cases they have made zero effort to do it. Their parents knew they were breaking the law when they came here, and they took a risk. Sometimes you get caught.

They have to go.

Unfortunately it is not over. Courts ruled Trumps EO unconstitutional. He cannot rule by fiat.

Until congress addresses DACA, they are here to stay.
